Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of checkappnames(the “Service”), operated by Ugur Seker (“we”, “us”, or “our”). By accessing the Service, creating an account, or purchasing a product, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use the Service.
1. The Service
checkappnames is an online tool that checks public Apple App Store listing data across multiple country storefronts and reports whether an app name appears to be taken or closely matched by existing applications. The Service relies on publicly available data from the iTunes Search API and does not provide legal, trademark, or intellectual property advice.
Results are informational. You remain solely responsible for conducting any additional due diligence, including trademark searches and manual storefront verification, before making naming or launch decisions.
2. Eligibility and accounts
You must be at least 13 years old to use the Service (or 16 where required by the laws of your country, such as certain EEA jurisdictions). If you are under the age of majority in your country, you may use the Service only with the involvement of a parent or guardian. Some features require signing in with a Google account. By signing in you confirm that the information provided to us via Google is accurate and that you are authorised to use that account.
You are responsible for safeguarding access to your account and for any activity performed under it. Notify us immediately at contact@checkappnames.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Access the Service through automated means, scrape or copy substantial portions of it, or attempt to bypass rate limits.
- Reverse engineer, decompile, or attempt to extract the source of any part of the Service, except as permitted by law.
- Use the Service to infringe the intellectual property, privacy, or other rights of any third party.
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
- Interfere with the operation of the Service, introduce malware, or attempt to gain unauthorised access to our systems.
4. Pricing and payments
The Service offers a free US App Store check and a paid one-time credit pack priced at 10 USD, which adds 1,000 credits (10 full scans) to your account. Each full scan covers all 43 App Store countries and Google Play and consumes 100 credits. Prices are displayed in US Dollars and exclude applicable taxes, which are calculated at checkout based on your billing location.
Payments are processed by Paddle.com Market Limited (“Paddle”), our Merchant of Record. By completing a purchase, you also accept Paddle’s buyer terms. Paddle is responsible for charging the applicable payment method and remitting any taxes due.
We may update pricing at any time. Price changes do not affect purchases already completed.
5. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
6. Intellectual property
The Service, including its design, text, graphics, and software, is owned by us or our licensors and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes in accordance with these Terms.
App names, developer names, icons, and other storefront metadata shown by the Service remain the property of their respective owners. We display this data to help you evaluate availability; no ownership is claimed.
7. Third-party data and services
The Service integrates with third-party providers, including Google (authentication), Upstash (data storage), Vercel (hosting), and Paddle (payments). We are not responsible for the availability, content, or practices of these third-party services. Your use of them is subject to their own terms.
The Service also depends on third-party data sources, including Apple’s public iTunes Search API and publicly available Google Play listing data. These sources are operated by third parties and may change, rate-limit, restrict, or discontinue access at any time without notice. We do not control these sources and do not guarantee continued access to them; any resulting interruption or change to the Service does not entitle you to a refund beyond what is stated in our Refund Policy.
8. Availability and disclaimers
The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, secure, or that the availability data returned will be complete, accurate, or up to date.
App Store data can change at any time, and recently published apps or metadata updates may not be reflected immediately. Do not rely solely on the Service for irreversible decisions.
9. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data, arising out of or related to your use of the Service.
Our aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) 10 USD.
Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law. Where your local law does not allow the exclusion or limitation of certain damages, the above limitations apply only to the extent permitted by that law.
10. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, or liability, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Service at any time if we believe you have breached these Terms or used the Service in a way that could harm us, other users, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination will do so.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above and, where appropriate, by notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles. Subject to the paragraph below, any dispute arising out of or in connection with these Terms shall be submitted to the competent courts and enforcement offices of İstanbul, Türkiye.
If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country in which you reside, and you may also bring proceedings in the courts of your country of residence where applicable law so requires.
